DALY CITY — A 28-year-old Daly City man is facing a nine-year prison sentence following felony convictions for assaulting a police officer with a gun and driving under the influence, prosecutors said.
On Wednesday, Rafael Jesus Candray Jr. pleaded no contest to the assault charge and received a sentence of six years, according to the San Mateo County District Attorney’s Office. Judge Michael K. Wendler also sentenced Candray to an additional three years behind bars for the DUI conviction. The two cases were not related.
The assault happened on Feb. 2, 2021, when officers were called to a home in the 1000 block of St. Francisco Boulevard for a report that Candray was drunk and abusing his mother, prosecutors said.
Candray was outside when officers arrived and ran away, according to the district attorney’s office. He returned two hours later and started banging on the door. Prosecutors said he was trying to force his way inside as an officer arrived at the home.
The officer went to pull Candray away from the door and felt a firearm in his jacket pocket, according to the district attorney’s office. The pair struggled over the gun, and at one point, Candray reportedly tried to point the weapon at the officer.
Prosecutors said the officer eventually gained control over both Candray and the firearm, which turned out to be a Ruger 357 revolver loaded with three live rounds.
The assault conviction represents Candray’s second strike under California’s three strikes law. He received his first strike in 2016 when he was convicted of robbery.
Candray has just over three years credit for time served, according to the district attorney’s office.
